SAMPLE CONTRACT

MEMORANDUM OF UNDERSTANDING

This agreement made this _____day of________, 2006, by and between the _______County Board of Education, hereinafter Board, and the _______ County Commission, hereinafter Commission. The term of this agreement shall be ____________ through ____________, 2006, unless otherwise officially amended by a grant adjustment from DCJS.

The parties to this agreement seek to memorialize their understanding concerning the provision of the services of a law enforcement officer to the ________ County School to serve in the position of a Prevention Resource Officer (PRO) as that term is defined in a grant to the Board from the West Virginia Division of Criminal Justice Services (DCJS). The Board agrees to pay to the Commission the sum of $_______per day for the services rendered by a PRO officer to the ________ County Schools. The PRO officer shall be a certified West Virginia law enforcement officer, a certified PRO officer and shall be assigned an official patrol car, uniform, and standard law enforcement equipment as assigned to other law enforcement officers serving under the _______ County Sheriff’s Department. The officer currently fulfilling this role is Deputy ___________.

The officer assigned to this position will follow all PRO guidelines in execution of his duties, and assist the Board in execution of its responsibilities for Special Conditions and Assurances under the DCJS Grant to the Board and other official documented agreements between the Board and the DCJS.

The officer shall perform the following services:

  • The officer will maintain an office located in ___________School as provided by the Board.
  • The officer will be in the school everyday that school is held, unless unavoidably absent due to illness or at a DCJS approved training.
  • In the event the officer is called away from the school for a Sheriff’s Department emergency or a court appearance unrelated to the school or duties originating with the school, the ________County Commission will deduct the hours absent from the school at $_______ per hour, thereby decreasing the daily billing by that amount.
  • The officer will conduct the business of a Prevention Resource Officer as defined in the grant from the DCJS, and according to the general outline of training provided by DCJS for PRO officers, PRO guidelines.
  • The officer will attend the required DCJS approved training for Prevention Resource Officers, and will be reimbursed for travel expenses at the allowable rate under West Virginia travel regulations. The ________County Board of Education will pay the travel expense and request reimbursement from the grant in their monthly report to DCJS.
  • The officer will be in the school a minimum of 35 hours per week and will attend as many extra curricular activities as possible at no extra charge to the ________County Board of Education, unless those services fall under an already existing time contract with the Sheriff’s Department.
  • Extra curricular activities may include: Ball games, field trips, track meets, Parent meetings, club meeting or any other school sponsored activity.

THIS MEMORANDUM OF UNDERSTANDING IS AN AGREEMENT FOR THE PROVISION OF CONTRACTED SERVICES. THE LAW ENFORCEMENT OFFICER REMAINS AN EMPLOYEE OF THE ___________ COUNTY COMMISSION THROUGH THE OFFICE OF THE ______ _COUNTY SHERIFF. RESPONSIBILITY FOR FRINGES AND BENEFITS, SUCH AS UNEMPLOYMENT INSURANCE, HEALTH INSURANCE, WORKER’S COMPENSATION, VACATION OR SICK LEAVE FOR THE OFFICER REMAIN WITH THE EMPLOYING AGENCY, NOT WITH THE _________ COUNTY BOARD OF EDUCATION.
